HC directs govt to hand over case to CBI

 GUWAHATI, Jan 6 – Apparently not satisfied with the investigation carried out by the Criminal Investigation Department (CID) of Assam Police, the Gauhati High Court today directed the State Government to hand over the journalist Anil Mazumdar murder case to the Central Bureau of Investigation (CBI) within 15 days.

The Court, however, did not disclose the contents of the status report of Assam Police’s investigation, which was submitted to it on January 4.

Mazumdar, a city-based journalist, was killed on March 24, 2009 around 10:30 pm in front of his residence at Rajgarh following which a case was registered with Chandmari police station under Sec 114/09 u/s 302 of the Indian Penal Code. Later, the case of handed over to the CID. Even after almost three years have passed, the investigators are yet to file the chargesheet in connection with the case.

Today’s judgment came in response to a writ petition (5885/11) filed by Mazumdar’s wife in November 2011 alleging indifferent attitude of the State Government and seeking High Court’s intervention. Senior advocate Nekibur Zaman appeared on behalf of the petitioner.

The Court had subsequently issued notices to Home department, DGP and SP (CID) seeking the status report.
