GUWAHATI, Aug 9 – The Gauhati High Court today passed an order in a writ petition filed by Arun Pathak directing the district administration of Kamrup (Metro) to close down all wine shops and bars in Guwahati which are situated within the radius of 500 metres from hospitals, dispensaries, nursing homes, religious, educational or other similar buildings and institutions effective from 5 pm today.
The writ petition was filed by Arun Pathak challenging the order dated March 29, 2012 which was passed by the Deputy Commissioner, Kamrup (M) on receipt of public complaint that the petitioner’s bar is located within the radius of 500 metres of a church situated at GS Road of the city.
Justice Ujjal Bhuyan after hearing the writ petition and after taking note of the submissions made by the senior government advocate, Assam, observed that same should be applied uniformly and not selectively and accordingly ordered that the district administration, Kamrup (Metro) shall close down all the bars and wine shops situated in Guwahati which are situated within a radius of 500 metres of hospitals, dispensaries, nursing homes, religious, educational or other similar buildings and institutions including those which are situated within a radius of 500 metres of the Gauhati High Court and other courts and tribunals of Guwahati city effective from 5 pm today. The court further directed the Deputy Commissioner, Kamrup (Metro) to submit the compliance report at 10.30 am tomorrow and fixed the case for further hearing on August 10, 2012.
