HC upholds SIC order against APSC STAFF Reporter GUWAHATI, Nov 6 – A division bench of the Gauhati High Court today allowed three petitions (WPC Nos 3054/2009; 3382/ 2009 and 3702/ 2009) filed by some of the aggrieved candidates of the Combined Competitive Examination, 2006 for Assam Civil Service Class –I (Junior grade) and Allied Services conducted by the Assam Public Service Commission (APSC). However, the Court dismissed the petition (WPC 3212/2009) filed by the APSC challenging the above petitions.
In their petitions, the candidates Hamen Bharali, Nilav Deva Goswami, Dr Lakhinandan Rajkhowa, Dr Abdul Jalil and Dhrubajyoti Das, among others prayed for judicial intervention in matters of securing photocopies of their answer scripts. They citied a judgement of the Assam Information Commission in favour of their plea.
They also alleged that the APSC had denied them the photocopies of their answer scripts despite the Information Commission directing the Public Service Commission to issue the same.
The APSC pleaded in its petition that the order of the Information Commission could not be effective in its case.
The Court of Justice Ranjan Gogoi and Justice BP Kataky after hearing both the sides said in its judgement today that it had allowed the petitions of the aggrieved candidates and dismissed the petition of the APSC thus upholding the order of State Information Commission.
